الأشغال الشاقة 15 سنة لمدانين بالقتل بنابلس
اصدرت محكمة بداية نابلس برئاسة القاضي امجد عرفات وعضوية القاضين عبد المالك سمود ومحمد جرادات، في وقت سابق حكما بإدانة المتهم الأول (ن،ش،أ)، والمتهم الثاني (ع،،ش،ا) عن تهمة القتل القصد بالاشتراك، سنداً لأحكام المادة 326 بدلالة المادة 76 من قانون العقوبات رقم 16 لسنة 1960.
وحكمت المحكمة على كل واحد منهما بالأشغال الشاقة لمدة 15 عاما، وعن التهمة الثانية وهي الشروع بالقتل القصد بالاشتراك سندا للمادة 326 بدلالة المادة 76و 68 من ذات القانون، وحكمت على كل واحد منهما بالأشغال الشاقة لمدة سبع سنوات ونصف، وعن التهمة الثالثة وهي إتلاف مال الغير سندا لأحكام المادة 445/1 من ذات القانون، وحكمت عليهما بالحبس لمدة ثلاثة أشهر.
وقررت دمج العقوبات، وذلك عملا بأحكام المادة (72) من قانون العقوبات، ونفذت العقوبة الأشد لتصبح الأشغال الشاقة لمدة 15 عاما لكل واحد من المدانين.
وجاء هذا الحكم استناداً إلى البينات والمرافعات التي قدمها وكيل النيابة العامة الأستاذ فادي اسليم، وذلك بعد أن قامت نيابة نابلس بإحالة الملف إلى المحكمة المختصة بعد إجراء التحقيقات اللازمة أصولا.
